Effective Date: March 17, 2026
IMPORTANT: By installing or using Bonsai POS, you agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree, do not install or use the software.
Bonsai POS grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Bonsai POS software ("Software") on one (1) computer, subject to your active paid subscription or trial period.
You may NOT:
The Software is owned by Bonsai POS and is protected by copyright law. This EULA does not transfer ownership. All rights not expressly granted are reserved.
You retain full ownership of all data you create using the Software. Your data is stored locally on your computer. Bonsai POS does not access, collect, or transmit your business data.
The Software requires an active subscription to operate in full mode. If your subscription expires or is cancelled, the Software will enter a read-only grace period allowing you to access and export your data.
Bonsai POS may provide updates to the Software. Updates are included with an active subscription. This EULA applies to all updates unless a separate agreement accompanies them.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU.
IN NO EVENT SHALL BONSAI POS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
This EULA is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination, the Software will enter read-only mode. You may access and export your existing data via the backup feature for 30 days. Your business data remains yours.
Bonsai POS is a software tool. You are solely responsible for: complying with PCI DSS standards when using external card terminals; maintaining accurate sales tax records; complying with labor laws; and obtaining necessary business licenses. Bonsai POS does not process, transmit, or store credit card data.
This EULA shall be governed by the laws of the State of Delaware, without regard to conflict of laws principles.
